A proposal to revise the Air Passenger Rights Regulation is currently blocked in the Council of the European Union with Member States.
The European Commission admitted that it does not expect it to enter into force within the next few years. In the meantime, it therefore announced the publication of its Interpretative Guidelines as an an attempt to codify the existing case law of the Court of Justice of the European Union in one single document, designed to help to ensure better application and enforcement of the existing legal provisions.
In this paper, BEUC focuses comments on the European Commission's intrepretation of the Air Passenger Rights Regulation and the good practice examples it refers to, instead commenting in detail on the judgments of the Court and its interpretation of the Regulation.
