The application and enforcement of existing air traveller rights is often far from satisfactory. Air transport tops the ranking of consumer complaints in the EU. The 2004 regulation has been a good basis for passengers’ rights, but it also created many problems, mostly due to uncovered gaps and frequently biased interpretation by the airline industry. A legislative revision was proposed in 2013 addressing the legal uncertainty, rare enforcement of air passenger rights and their adaptation in light of the judgments of the European Court of Justice. However, the review has been blocked at the Council of Ministers’ level for several years.
