Why did BEUC file a complaint against Temu?
BEUC filed a complaint with the European Commission, while 17 of its members and other consumer organisations filed the same complaint with their competent national authorities, after identifying that Temu was failing to protect consumers by breaching the EU’s Digital Services Act.
What is BEUC complaint against Temu based on?
BEUC’s complaint against Temu identified the following breaches:
- Failing to provide sufficient traceability of the traders that sell on its platform and thereby to ensure that the products sold to EU consumers conform to EU law.
- Using manipulative practices such as dark patterns to get consumers, for example, to spend more than they might originally want to, or to complicate the process of closing their account.
- Failing to provide transparency about how it recommends products to consumers.
Currently, the action is under examination by the European Commission.
What is the real impact on consumers?
The real impact on consumers is exposure to an online marketplace that lacks predictability, transparency and safeguards, increasing the risk of manipulation and uncertainty about who is selling products on the platform. This undermines consumers’ ability to make informed and safe purchasing decisions.
Which BEUC members and consumer organisations took part in this action?
The following BEUC members took part in this action:
Kypriakos Syndesmos Katanaloton/CCA (Cyprus), dTEST (Czech Republic), Forbrugerrådet Tænk (Denmark) Que Choisir Ensemble (France), EKPIZO (Greece), Consumentenbond (The Netherlands), Forbrukerradet (Norway), Spoločnosť ochrany spotrebiteľov/S.O.S. (Slovakia), Zveza Potrošnikov Slovenije/ZPS (Slovenia), Sveriges Konsumenter (Sweden), ASUFIN (Spain), and Fédération Romande des consommateurs/FRC (Switzerland). Verbraucherzentrale Bundesverband/vzbv (from Germany) sent a legal warning to TikTok instead of contacting the German authorities.
The following consumer organisations also supported the action:
Altroconsumo and Consumatori Italiani per l'Europa/CIE (Italy) Testachats/Testaankoop in (Belgium), Organizacion de Consumidores y Usuarios/OCU (Spain).
In its complaint against Temu, BEUC is calling on the European Commission and the competent authorities to take the following actions:
- Ensure that Temu fully respects all its obligations under EU law.
- Transfer the complaints against Temu from the national Digital Services Coordinators to the Irish authority, as its EU office is located in Ireland.
- Require the Irish authority to act swiftly to bring the platform into compliance with the Digital Services Act, as consumers cannot afford lengthy enforcement procedures.
- Ensure that, if the European Commission designates Temu as a very large online platform (VLOP), it promptly enforces the Digital Services Act and requires compliance with VLOP specific obligations, including risk assessment and mitigation.
